Misconduct - A Range of Situations with Termination as a Last Resort.

Misconduct covers a range of issues, not just one specific issue. If employees fail to fulfill their obligations according to the employment agreement, they may be considered to be misconducting.

The employer should work preventively to ensure that employees do not engage in misconduct and neglect their responsibilities.
If an employee engages in misconduct, the employer should provide an oral reprimand.
If that is not sufficient, the employer may issue a written reminder, possibly followed by disciplinary action with support from the law or agreement.

If the misconduct continues, the employer may, as a last resort, terminate the employment. The concept of misconduct includes the following:

  • Refusal to work
  • Criminal activity
  • Poor work performance
  • Difficulties in cooperation
  • Competing sideline activities
  • Unfaithful behavior
