What is considered as competing business?

A side business is essentially anything that an employee engages in temporarily or permanently alongside their employment. This can involve running one's own business or working extra in a position alongside the employees' regular work.

If the side business is similar to the regular business, it may be considered as competing.

An employer can prohibit a side business if it competes with the employer's business. The Labour Court has consistently considered such competing side business as grounds for termination or dismissal.
